What We Expect:

  • Use the platform for legitimate business planning and development
  • Provide accurate information about your business needs
  • Use the Service responsibly and legally

What You Keep:

  • Complete ownership of your business ideas and plans
  • Control over your personal information and business data
  • The right to cancel your account anytime and request data deletion

What's Important to Know:

  • This Service is intended for users in the United States
  • Your personal data and business ideas are never sold or shared with third parties
  • We may use your conversations internally to improve Hai and our platform
  • We can't guarantee perfect uptime or that Hai will always have the right answer
  • Hai provides suggestions, not professional legal, financial, or business advice
  • This agreement helps us maintain a valuable service for entrepreneurs

Fridays at Four helps entrepreneurs and small business owners stay organized and motivated throughout their business journey. Our platform combines AI partnership with practical business knowledge to help you navigate the complex process of starting and growing a business.

These Terms of Service explain how our platform works and the guidelines that help us provide reliable service to everyone. We encourage you to read them carefully before using Fridays at Four.

1. Definitions

  • "Fridays at Four," "we," "us," or "our" refers to the organization providing these services
  • "Service" or "Platform" refers to our website, application, and AI assistant (Hai)
  • "AI Assistant" or "Hai" refers to our AI business partner service
  • "Content" refers to any information, data, text, or business information you share on our platform
  • "User," "you," or "your" refers to the individual or entity using our Service

2. Eligibility

You must be at least 18 years of age to create an account and use our Service. By creating an account, you represent and warrant that you are at least 18 years old.

This Service is intended for users in the United States. If you access the Service from outside the US, you do so at your own risk and are responsible for compliance with local laws.

3. Account Registration and Security

Account Creation:

  • You must provide accurate, current, and complete information during registration
  • You must maintain and update your account information to keep it accurate
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account

Account Security:

  • You must notify us immediately of any unauthorized access or security breach
  • You must use a strong, unique password for your account
  • You may not share your account credentials with others
  • You may not allow others to access your account

4. AI Assistant Usage and Data Rights

How Our AI Works:

Users acknowledge and agree that:

  • Hai processes and remembers your interactions to provide personalized business support
  • Chat histories are maintained for service continuity and your ongoing progress
  • Interactions should remain professional and appropriate for business purposes

Data Usage for Service Improvement:

To continuously improve our AI assistant and platform, we may use your conversations and data internally for:

  • Service enhancement and feature development
  • Improving our AI systems, prompts, and algorithms
  • Research purposes to better serve entrepreneurs
  • Quality assurance and safety monitoring

We analyze usage patterns and conversations to improve our services.

Your Data Protection:

Your personal data and business ideas are never sold or shared with third parties. We use your information only to make Fridays at Four better for you and future users.

What we NEVER do:

  • Sell your data to anyone
  • Share your individual conversations with third parties
  • Give other users or organizations access to your data
  • Use your specific business ideas for our own ventures

5. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Impersonate any person or entity or misrepresent your affiliation
  • Harass, abuse, or harm another person or entity
  • Interfere with or disrupt the Service or servers/networks connected to the Service
  • Attempt to gain unauthorized access to any portion of the Service
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Reverse engineer, decompile, or disassemble any portion of the Service
  • Remove or modify any copyright, trademark, or proprietary notices
  • Use the Service to spam, phish, or distribute malware
  • Share access credentials with unauthorized users
  • Upload viruses or malicious code
  • Violate any applicable laws or regulations

6. AI-Generated Content: Important Disclaimers

Nature of AI Assistance:

Hai provides business support and suggestions, but users must understand:

NOT Professional Advice:

  • Hai is not a substitute for professional legal, financial, accounting, or business consulting advice
  • AI responses do not constitute professional services or create any professional relationship
  • You should consult qualified professionals for specialized guidance on legal, financial, or regulatory matters

Potential for Errors:

  • AI may produce errors, outdated information, or "hallucinations" (plausible-sounding but incorrect information)
  • Business regulations, laws, and requirements change frequently - always verify current requirements
  • We do not guarantee that AI responses will be accurate, complete, or suitable for your specific situation

Your Responsibility:

  • You are solely responsible for evaluating the accuracy and appropriateness of AI-generated content
  • You must verify important information before relying on it for business decisions
  • You must ensure AI-generated content complies with applicable laws and regulations in your jurisdiction
  • You are responsible for all business decisions you make, whether influenced by Hai or not

No Guarantees of Success:

  • We make no guarantees about business success, profitability, or outcomes
  • Business success depends on many factors outside our control
  • Past performance and examples do not guarantee future results

7. Intellectual Property Rights

Your Business Content:

  • You retain full ownership of your business ideas, plans, and intellectual property
  • Your business details and strategic information remain yours
  • We never claim ownership of your business concepts or proprietary information

License You Grant Us:

By using our Service, you grant Fridays at Four a limited, non-exclusive, worldwide license to:

  • Process and store your content to provide the Service
  • Display your content back to you through the AI assistant
  • Use your content internally to improve our AI and platform

This license ends when you delete your content or account, except for:

  • Data we're required to retain by law
  • Backup copies (deleted within 90 days)
  • Anonymized data already incorporated into service improvements

Platform Content:

  • All platform features, AI responses, interface design, and service functionality are owned by Fridays at Four
  • You may not copy, reproduce, modify, or create derivative works of our platform technology
  • You may not extract our business knowledge base or AI training data
  • Our trademarks, logos, and brand elements may not be used without permission

8. Subscription and Billing

Payment Terms:

  • Subscriptions are billed according to your chosen plan (monthly or annual)
  • All fees are stated in U.S. dollars
  • Payment is processed through Stripe, Inc. (see Privacy Policy for details)
  • You authorize us to charge your payment method for all fees incurred

Automatic Renewal:

  • Subscriptions automatically renew at the end of each billing period
  • You will be charged the then-current rate unless you cancel before renewal
  • We will provide reasonable notice of price increases (at least 30 days)

Refund Policy:

  • All fees are non-refundable except as required by law
  • No refunds for partial months or unused portions of subscription periods
  • We may, at our sole discretion, provide refunds or credits on a case-by-case basis

Free Trials:

  • Free trial periods (if offered) are available only once per user
  • We may require payment information to start a free trial
  • You will be charged when the trial period ends unless you cancel beforehand
  • We reserve the right to determine free trial eligibility

Cancellation:

  • You may cancel your subscription at any time through account settings or by contacting hello@fridaysatfour.co
  • Cancellation takes effect at the end of your current billing period
  • You retain access to the Service until the end of your paid period
  • No refunds are provided for early cancellation

Failed Payments:

  • If payment fails, we will attempt to charge your payment method again
  • Your access may be suspended if payment remains unsuccessful
  • Your account may be terminated if payment issues are not resolved within 30 days

9. Service Availability and Limitations

Service Commitment:

While we work hard to keep Fridays at Four running smoothly:

  • We cannot guarantee 100% uptime or uninterrupted service
  • We may perform scheduled maintenance with reasonable notice
  • Our AI assistant, while sophisticated, has limitations and may not always provide perfect answers
  • Business regulations and requirements are complex and constantly evolving
  • We reserve the right to modify or discontinue features with reasonable notice (at least 30 days for material changes)

Service Modifications:

  • We may update, change, or discontinue any aspect of the Service at any time
  • We will provide notice of material changes that significantly affect functionality
  • Continued use after changes constitutes acceptance of modifications

Third-Party Services:

  • Our Service relies on third-party providers (including AI providers, Stripe, Supabase, Vercel - see Privacy Policy)
  • We are not responsible for third-party service interruptions or failures
  • Third-party terms and policies may also apply to your use of the Service

10. Data Retention and Deletion

Data Retention:

  • We retain your data for as long as your account is active
  • When you cancel your account, your data is retained for service improvement and legal compliance
  • We may use retained data internally to improve our AI and platform

Data Deletion:

  • If you want your data permanently deleted, you may request deletion by emailing hello@fridaysatfour.co
  • We will process deletion requests within 30 days
  • Some records (invoices, tax records, security logs) may be retained as required by law
  • Backup copies may persist for up to 90 days but are removed in normal backup rotation

Data Backup:

  • You are responsible for maintaining backup copies of important business information
  • We are not liable for loss of data due to technical issues, service interruptions, or account termination
  • We recommend regularly exporting important business plans and documents

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Disclaimer of Warranties:

  • THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND
  • WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
  • WE DO NOT WARRANT THAT AI RESPONSES WILL BE ACCURATE, COMPLETE, OR RELIABLE

Limitation of Liability:

  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR SERVICES IN THE PAST 12 MONTHS
  • WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES
  • WE ARE NOT LIABLE FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION
  • WE ARE NOT RESPONSIBLE FOR BUSINESS DECISIONS YOU MAKE BASED ON AI SUGGESTIONS
  • WE ARE NOT LIABLE FOR REGULATORY VIOLATIONS, PERMIT DENIALS, OR BUSINESS FAILURES

Specific Exclusions:

  • Damages resulting from reliance on AI-generated content
  • Losses from inaccurate, outdated, or incomplete business information
  • Legal or financial consequences of business decisions
  • Third-party actions or service failures
  • Unauthorized access resulting from your failure to secure your account
  • Data loss or corruption

Exceptions:

  • These limitations do not apply where prohibited by law
  • These limitations do not apply to damages resulting from our gross negligence or willful misconduct
  • Some jurisdictions do not allow certain limitations, so some limitations may not apply to you

12. Indemnification

You agree to indemnify, defend, and hold harmless Fridays at Four, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use or misuse of the Service
  • Your violation of these Terms of Service
  • Your violation of any applicable laws or regulations
  • Your violation of any third-party rights (including intellectual property, privacy, or publicity rights)
  • Any business decisions you make based on AI-generated content
  • Unauthorized access to your account due to your failure to secure credentials
  • Any content or information you submit to the Service

13. Dispute Resolution

Informal Resolution:

We encourage resolving disputes through direct communication with our team at hello@fridaysatfour.co. Most issues can be resolved quickly through friendly conversation. You agree to attempt informal resolution before initiating arbitration or legal proceedings.

Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY - IT AFFECTS YOUR LEGAL RIGHTS AND HOW DISPUTES ARE RESOLVED

Arbitration Agreement:

For disputes that cannot be resolved informally, you and Fridays at Four agree to resolve disputes through binding arbitration instead of court proceedings, except as specified below. This arbitration agreement is governed by the Federal Arbitration Act (FAA).

Covered Disputes:

  • All disputes, claims, or controversies arising from or relating to these Terms
  • Your use of our Service or inability to use our Service
  • Your relationship with Fridays at Four
  • Privacy or data protection concerns
  • Billing or subscription disputes
  • Any other matter relating to the Service

Arbitration Rules:

  • Disputes will be resolved through final and binding arbitration under the Consumer Arbitration Rules of the American Arbitration Association (AAA)
  • The arbitrator's decision is final and binding
  • Judgment on the arbitration award may be entered in any court having jurisdiction

Location:

  • Arbitration will take place in your county of residence
  • Or via videoconference if you prefer
  • Or at another mutually agreed location

Costs:

  • Each party pays their own attorney's fees and costs
  • We'll cover AAA filing fees for claims under $10,000
  • The arbitrator may award fees and costs to the prevailing party if permitted by law

Exceptions to Arbitration:

The following disputes are NOT subject to arbitration:

  • Small claims court actions (if they remain in small claims court)
  • Claims related to intellectual property infringement
  • Claims seeking injunctive relief for security breaches

Class Action Waiver:

YOU AND FRIDAYS AT FOUR AGREE THAT DISPUTES MUST BE BROUGHT INDIVIDUALLY AND NOT AS PART OF ANY CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING.

  • You waive the right to participate in class actions or class-wide arbitration
  • You may not act as a class representative or class member in any class action
  • The arbitrator may not consolidate multiple parties' claims without all parties' consent
  • The arbitrator may award relief only in favor of the individual party seeking relief

Opt-Out Right:

You may opt out of this arbitration agreement by sending written notice to hello@fridaysatfour.co within 30 days of accepting these Terms. Your notice must include:

  • Your full name
  • Email address associated with your account
  • Clear statement: "I opt out of the arbitration agreement"

If you opt out, all other terms still apply, but disputes will be resolved in court rather than arbitration.

Severability of Arbitration Provision:

If the class action waiver is found to be unenforceable, the entire arbitration agreement is void, and disputes will be resolved in court. If any other part of this arbitration agreement is found unenforceable, the remainder continues in effect.

14. Governing Law and Jurisdiction

Governing Law:

  • These Terms are governed by the laws of the State of California, United States
  • Federal law applies where applicable
  • Without regard to conflict of law provisions

Jurisdiction (if arbitration doesn't apply):

  • You agree to submit to the personal jurisdiction of state and federal courts located in Sacramento County, California
  • You waive any objection to venue in these courts

15. Privacy and Data Protection

Your privacy is important to us. Our data collection, use, storage, and protection practices are detailed in our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you also agree to our Privacy Policy. Key points include:

16. Modifications to Terms

Our Right to Modify:

We reserve the right to modify these Terms at any time. When we make changes:

  • Material changes include modifications to pricing, arbitration terms, limitation of liability, or core Service features
  • You may terminate your account if you disagree with material changes
  • Continued use after the notice period constitutes acceptance

Non-Material Changes:

  • Minor clarifications, formatting updates, or contact information changes may be made without notice
  • The "Last Updated" date at the top will always reflect the most recent changes

Version History:

  • We maintain a version history of Terms changes
  • You can request previous versions by contacting hello@fridaysatfour.co

Your Options:

  • If you disagree with changes, you may terminate your account before changes take effect
  • Termination does not entitle you to refunds for prepaid subscription periods

17. Termination

Termination by You:

You may terminate your account at any time by:

  • Using account settings to delete your account
  • Contacting hello@fridaysatfour.co
  • Canceling your subscription (access continues until end of billing period)

Effect of Your Termination:

  • Your access to the Service ends immediately (or at end of billing period for cancellations)
  • Your data will be handled according to our Privacy Policy and Section 10 of these Terms
  • No refunds for unused portions of subscription periods
  • You remain responsible for any outstanding fees

Termination by Us:

We may suspend or terminate your account immediately, without notice, for:

  • Violation of these Terms of Service
  • Fraudulent activity or payment disputes
  • Abusive conduct or harassment
  • Misuse of the AI assistant or platform features
  • Non-payment of fees (after reasonable notice and opportunity to cure)
  • Illegal activity or violation of applicable laws
  • Prolonged inactivity (no login for 12 consecutive months), with advance notice

Effect of Our Termination:

  • Your access to the Service ends immediately
  • Outstanding fees remain due and payable
  • No refunds for terminated accounts (unless termination was in error)
  • We may delete your data according to our Privacy Policy

Survival:

The following provisions survive termination:

  • Intellectual Property Rights
  • Limitation of Liability
  • Indemnification
  • Dispute Resolution
  • Governing Law
  • Any provisions that by their nature should survive

18. General Provisions

Entire Agreement:

  • These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fridays at Four
  • They supersede all prior communications, agreements, or understandings (written or oral)

Severability:

  • If any provision is found invalid, illegal, or unenforceable, it will be modified to the minimum extent necessary to make it valid
  • If modification is not possible, the provision will be severed
  • The remaining provisions continue in full force and effect

No Waiver:

  • Our failure to enforce any provision does not waive our right to enforce it later
  • Waiver of one breach does not waive subsequent breaches
  • All waivers must be in writing to be effective

Assignment:

  • You may not assign or transfer these Terms or your account without our written consent
  • We may assign these Terms in connection with a merger, acquisition, or sale of assets
  • We will provide notice of any assignment that materially affects your rights

Force Majeure:

  • We are not liable for delays or failures due to circumstances beyond our reasonable control
  • Including natural disasters, war, terrorism, labor disputes, government actions, or internet/telecommunications failures

Notices:

  • We may provide notices via email, platform notification, or posting on our website
  • You consent to receive electronic communications from us
  • Notices to us must be sent to: hello@fridaysatfour.co

Relationship:

  • These Terms do not create any partnership, joint venture, employment, or agency relationship
  • You may not make commitments on our behalf

Third-Party Beneficiaries:

  • These Terms do not create rights for any third parties
  • Except that our affiliates and service providers may enforce provisions that protect them

20. Acknowledgment and Acceptance

By creating an account, accessing, or using the Service, you acknowledge and agree that:

  • You have read, understood, and agree to be bound by these Terms of Service
  • You have read and agree to our Privacy Policy
  • You are at least 18 years of age
  • You understand that Hai provides suggestions, not professional advice
  • You understand that AI-generated content may contain errors and should be independently verified
  • You understand your data rights and how to exercise them
  • You consent to electronic communications from us
  • You understand the arbitration and class action waiver provisions
  • You agree to use the Service responsibly and in compliance with all applicable laws
